Welcome to Forever French. These Terms of Service (“Terms”) govern your access to and use of shopforeverfrench.com (the “Site”) and any products or services made available through the Site.

The Site is operated by Forever French Co. (“Forever French,” “we,” “us,” or “our”).

By accessing or using the Site, placing an order, or otherwise using our services, you agree to these Terms and any policies incorporated into them, including our Privacy Policy and applicable Return/Refund Policy.

If you do not agree to these Terms, please do not use the Site.

1. Eligibility

By using the Site, you represent that:

• You are legally capable of entering into a binding agreement under applicable law;

• You are at least the age of majority in the jurisdiction where you reside, or you are using the Site with the permission and supervision of a parent or legal guardian where permitted by law; and

• You will comply with these Terms and all applicable laws and regulations.

2. Our Online Store

Our store is hosted on Shopify, which provides the ecommerce platform that allows us to offer our products and services.

Shopify and other third-party providers may provide portions of the technology, payment processing, hosting, shipping, analytics, communications, and other services used to operate the Site.

3. Products and Product Information

We make reasonable efforts to accurately describe and display our products.

However:

• Product colors may appear differently depending on your device or display.

• Product availability may change without notice.

• Product descriptions, photographs, specifications, pricing, and availability may contain errors or omissions.

• We reserve the right to correct errors and update product information at any time.

We do not guarantee that every product description, photograph, specification, price, or other information on the Site is complete, accurate, current, or error-free.

4. Orders and Acceptance

When you place an order, you are making an offer to purchase the products in your order.

Receipt of an order confirmation does not necessarily mean that we have accepted your order. We reserve the right to accept, reject, limit, or cancel an order for any lawful reason, including suspected fraud, pricing errors, inventory limitations, suspected resale activity, or other circumstances affecting the transaction.

If we cancel or materially modify an order after payment has been submitted, we will generally attempt to notify you and, where appropriate, refund amounts paid for the canceled portion of the order.

5. Pricing and Payment

Prices displayed on the Site are subject to change without notice.

Applicable taxes, shipping charges, and other disclosed charges may be added to your order.

You agree to provide accurate and current billing, shipping, payment, and contact information.

Payment information may be processed by third-party payment processors. You authorize us and our payment providers to charge the payment method associated with your order for the applicable purchase price, taxes, shipping charges, and other amounts disclosed during checkout.

6. Shipping and Delivery

Shipping and delivery estimates are provided for convenience and are not guarantees unless expressly stated otherwise.

Delivery times may be affected by inventory availability, carriers, weather, customs, holidays, and circumstances outside our reasonable control.

You are responsible for providing an accurate shipping address.

Once an order is delivered to the address provided at checkout, responsibility for the shipment may be governed by applicable law, carrier terms, and the circumstances of the delivery.

7. Returns, Refunds, and Exchanges

Returns, refunds, cancellations, and exchanges are governed by our applicable Return/Refund Policy.

If our Return/Refund Policy conflicts with these Terms regarding the specific return or refund procedure for a product, the Return/Refund Policy will control for that issue.

8. Accounts

If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for activity occurring through your account.

You agree to provide accurate information and to promptly update information that becomes inaccurate.

We may suspend or terminate an account where reasonably necessary to protect the Site, our customers, our business, or third parties, or where you violate these Terms or applicable law.

We reserve the right to restrict or terminate access to the Site for violations of these Terms or applicable law.

10. Intellectual Property

The Site and its contents, including text, photographs, graphics, logos, trademarks, product images, designs, videos, software, and other materials, are owned by or licensed to Forever French and are protected by applicable intellectual-property laws.

Except as expressly permitted by us or applicable law, you may not reproduce, modify, distribute, publicly display, create derivative works from, sell, or otherwise exploit Site content without our prior written permission.

Nothing in these Terms grants you ownership of our intellectual property.

11. User Content and Reviews

If you submit reviews, comments, photographs, testimonials, suggestions, or other content to us or through the Site (“User Content”), you retain ownership of your User Content.

However, by submitting User Content, you grant Forever French a non-exclusive, worldwide, royalty-free, transferable and sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, display, and otherwise use that User Content in connection with our business and marketing, subject to applicable law.

You represent that:

• You own or have the necessary rights to submit the User Content;

• Your User Content does not violate the rights of another person or entity;

• Your User Content is not unlawful, fraudulent, defamatory, obscene, threatening, or otherwise prohibited by law;

• Your User Content does not contain malicious code; and

• Your User Content does not falsely imply an affiliation with Forever French.

We may remove or decline to publish User Content for lawful reasons, including where it violates these Terms or applicable law.

12. Third-Party Services and Links

The Site may contain links to or integrations with third-party websites, applications, services, or tools.

We do not control third-party services and are not responsible for their content, policies, availability, security, or practices.

Your use of third-party services may be subject to separate terms and privacy policies imposed by those third parties.

13. Privacy

Our collection and use of personal information are described in our Privacy Policy.

By using the Site, you acknowledge that you have reviewed our Privacy Policy.

14. Errors and Corrections

The Site may occasionally contain typographical errors, inaccuracies, or omissions relating to product descriptions, prices, promotions, availability, shipping charges, or other information.

We reserve the right to correct errors, update information, change or cancel orders, and modify Site content where permitted by law.

We are not obligated to update every piece of information on the Site unless required by applicable law.

15. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Site and its content are provided on an “as is” and “as available” basis.

To the maximum extent permitted by law, Forever French disclaims warranties that the Site will be uninterrupted, secure, error-free, or free from harmful components, and disclaims implied warranties except where such warranties cannot lawfully be excluded.

Nothing in these Terms excludes or limits a warranty or consumer protection right that cannot legally be excluded or limited.

16. Limitation of Liability

To the maximum extent permitted by applicable law, Forever French Co. and its owners, officers, employees, contractors, affiliates, suppliers, service providers, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, savings, business opportunities, or data, arising out of or relating to your use of the Site, your inability to use the Site, or your purchase or use of products obtained through the Site.

To the maximum extent permitted by applicable law, our total liability arising out of or relating to the Site or a purchase will not exceed the amount you paid to us for the product or service giving rise to the claim during the applicable transaction.

These limitations do not apply to liability that cannot legally be limited or excluded.

17. Indemnification

To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Forever French Co. and its owners, officers, employees, contractors, affiliates, suppliers, service providers, and licensors from claims, liabilities, damages, losses, and reasonable expenses, including reasonable attorneys' fees, arising from:

• Your violation of these Terms;

• Your violation of applicable law;

• Your User Content; or

• Your infringement or violation of another person's rights.

18. Termination

We may suspend or terminate your access to the Site or services where permitted by law if you violate these Terms, engage in fraudulent or unlawful activity, or otherwise create a risk to the Site, our business, our customers, or third parties.

Provisions that by their nature should survive termination will survive, including provisions concerning intellectual property, disclaimers, limitation of liability, indemnification, dispute resolution, and governing law.

19. Governing Law

These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-law rules, except to the extent applicable law requires otherwise.

20. Dispute Resolution and Venue

Before filing a legal claim, you agree to contact us at ShopForeverFrench@gmail.com and provide a brief written description of the dispute and the relief requested. We will have a reasonable opportunity to attempt to resolve the dispute informally.

To the extent permitted by applicable law, any court proceeding arising out of or relating to these Terms or your use of the Site shall be brought in the state or federal courts located in Maricopa County, Arizona, and you consent to their jurisdiction and venue.

Nothing in this section limits rights that cannot lawfully be waived or limits a consumer's right to bring a claim in another forum where applicable law provides that right.

21. Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law and the remaining provisions will remain in effect.

 

22. SMS and RCS Messaging Terms

By opting in to receive text messages from Forever French, you agree to receive recurring automated text messages from Forever French Co. at the mobile telephone number you provide. These messages may be delivered through SMS, MMS, and/or Rich Communication Services (“RCS”), depending on your device, carrier, messaging application, and network availability.

Messages may include promotional offers, new product announcements, collection launches, restock notifications, sales, order-related communications, customer service communications, and other updates related to Forever French.

Message frequency varies based on your interactions with us, your preferences, and the messaging program to which you have subscribed.

Message and data rates may apply.

Your consent to receive marketing messages is not a condition of purchasing any product or service from Forever French.

Consent

By providing your mobile number and affirmatively opting in to receive text messages, you authorize Forever French to send recurring automated marketing messages to that number using SMS, MMS, and/or RCS.

Your messaging consent is separate from your agreement to these Terms and is not required to make a purchase, create an account, or use the Site.

If you provide a mobile number that belongs to another person, you represent that you have that person's authorization to provide the number and enroll it in the applicable messaging program.

RCS Messaging

Where available, Forever French may use RCS to provide enhanced messaging experiences, including rich media, images, videos, links, product information, interactive buttons, and other messaging features supported by your device, carrier, and messaging application.

RCS availability and functionality may vary by device, operating system, carrier, geographic location, network connection, and other technical factors. Not all recipients will receive RCS messages, and messages may be delivered through another supported messaging channel where permitted by the applicable messaging provider.

RCS business messages may be associated with a verified Forever French business profile where supported by the applicable RCS provider.

How to Opt Out

Reply STOP at any time to cancel recurring marketing messages.

You may also use an unsubscribe function made available by your messaging application or RCS provider, where available.

After you opt out, you may receive a confirmation message. You will no longer receive recurring marketing messages from the applicable messaging program, although you may continue to receive necessary transactional or service-related communications, such as order confirmations, shipping updates, or other messages directly related to transactions or services you have requested.

You may re-subscribe by following the instructions provided in the applicable messaging service or by providing a new affirmative opt-in where available.

Changes to Your Mobile Number

If you change or deactivate your mobile telephone number, please update your messaging preferences or contact Forever French so that we can update our records.

No Guarantee of Delivery

Message delivery is subject to your mobile carrier, messaging provider, device, network, and other factors outside our reasonable control. Carriers are not liable for delayed or undelivered messages.

Privacy

Our collection and use of personal information, including information associated with text messaging and RCS communications, are described in our Privacy Policy.

Text messaging opt-in data and consent will not be sold or shared with third parties for their own marketing or promotional purposes. Messaging information may be shared with service providers and technology partners as reasonably necessary to provide, operate, maintain, or support our messaging services, subject to applicable law and our Privacy Policy.

Messaging Provider

SMS, MMS, and/or RCS messages may be transmitted through third-party messaging providers, carriers, and other technology providers. Your use of messaging services may also be subject to the terms and policies of your mobile carrier, messaging application, and applicable messaging provider.

 

23. No Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or our right to enforce it later.

24. Entire Agreement

These Terms, together with policies expressly incorporated into them, constitute the agreement between you and Forever French concerning your use of the Site and supersede prior agreements concerning the same subject matter.

25. Changes to These Terms

We may update these Terms from time to time.

When we make changes, we will update the “Last Updated” date above. Your continued use of the Site after revised Terms are posted constitutes acceptance of the revised Terms to the extent permitted by applicable law.

For material changes, we may provide additional notice where appropriate or required by law.
